In order to identify data protection specialists who have passed a qualification examination and to ensure that information on data protection specialists is available, the Data State Inspectorate shall keep a list of data protection specialists. The list of data protection specialists shall include only those persons who have passed the qualification examination of the personal data protection specialist. Person excluded from the list of data protection professionals for the following reasons:
1) a written request has been received by the State Data Inspectorate;
2) for a person who has been excluded from the list, the court has established a guardianship;
3) a person who has been removed from the list by a court judgment from the right to work as a data protection specialist or other restrictions specified, which do not permit the fulfilment of the relevant professional duties;
a renewal may be requested from the list and the Data State Inspectorate shall re-include it in the list of data protection specialists if the reasons for which the person was excluded from the list have been removed.

Process description

  1. Application regarding renewal in the list of a personal data protection specialist
    A person who has been excluded from the list of data protection specialists in accordance with Section 20, Paragraph one, Clauses 1, 2 or 3 of the Law on Data Processing of Natural Persons shall submit a submission which includes a request for renewal in the data protection list.

  2. Evaluation of the application and taking of a decision
    The State Data Inspectorate shall, within one month, evaluate the information provided in the data protection specialist list of the application regarding the renewal, as well as the attached documents (if such documents have been submitted) and take a decision:
    1) regarding inclusion in the list of data protection specialists, if the reasons for which the person was excluded from the list have been eliminated;
    2) regarding the refusal to list personal data protection specialists, if the reasons for which the person was excluded from the list have not been eliminated

  3. Notification of the service
    The decision shall be communicated electronically to the channel indicated in the applicant's application.
    If the official electronic address account has been activated, the State Data Inspectorate shall send the decision using the official electronic address if the request for communication to the electronic mail address is not substantiated in the application for renewal in the list of the personal data protection specialist.
