In order to maintain a qualification, a data protection specialist as an instructor or training participant shall participate in refresher activities (training) in the field of personal data protection or in another field related to the performance of the duties of a data protection specialist (not less than 36 academic hours during the three years following the inclusion in the list or Regulation No 620 of 6 October 2020 “Data protection” professional qualification rules' for the adoption of the decision referred to in Sub-paragraph 50.1, of which not less than 18 academic hours in the field of personal data protection).
A data protection specialist shall submit to the State Data Inspectorate a submission regarding the recognition of the maintenance of the qualification of a data protection specialist, not later than three years and two months from the date of the decision regarding the inclusion of a data protection specialist in the list or the decision regarding recognition of the maintenance of a qualification. The submission shall be accompanied by the documents available to the data protection specialist, which shall certify the duration of all the training activities visited and their successful completion, the information regarding the training organisation, the orientation and subject of training, the programme, the targeting of training, a statement regarding the relevant number of academic hours obtained by participating as an instructor or as a member of the training.

    A data protection specialist shall, not later than three years and two months from the date of the decision regarding the inclusion of a data protection specialist in the list or the decision regarding the recognition of the maintenance of a qualification, submit to the Inspectorate a free form application regarding the recognition of the maintenance of the qualification of a data protection specialist. The submission shall be accompanied by the documents available to the data protection specialist, which shall certify the duration of all the training activities visited and their successful completion, the information regarding the training organisation, the orientation and subject of training, the programme, the targeting of training, a statement regarding the relevant number of academic hours obtained by participating as an instructor or as a member of the training.

  2. Decision making
    The State Data Inspectorate shall take one of the following decisions within one month after receipt of the submission and the documents attached thereto:
    1. to fully recognise training as a measure of increasing the qualification of a data protection specialist in determining the number of academic hours and to recognise the maintenance of the qualifications of a data protection specialist;
    2. refuse to recognise training as a measure of increasing the qualification of a data protection specialist and to remove a data protection specialist from the list;
    3. to partly recognise training as the maintenance of the qualification of a data protection specialist and the qualification of a data protection specialist, by determining the obligation of the data protection specialist to participate in the number of academic hours specified in the training, if the duration of the training visited by a data protection specialist is at least 18 academic hours, but less than 36 academic hours.

  3. Notification of the decision
    The decision shall be sent to the electronic mail address indicated in the application of the person.
